Organisé par le Centre sur les droits de la personne et le pluralisme juridique. Bienvenue à tous et toutes!\n\nRésumé\n\n[En angl ais seulement] On April 28\, 2010\, the Brazilian Supreme Court (STF) uphe ld the constitutionality of the Brazilian Amnesty Law enacted at the end o f the military regime and reinforced by the Constitutional Amendment conve ning the Constituent National Assembly.\n\nSix months later\, on November 24\, the Inter-American Court of Human Rights (IACHR) declared that the Br azilian Amnesty Law is incompatible with the American Convention\, lacks l egal effects and cannot be used as an obstacle to investigating and prosec uting those responsible for grave violations of human rights.\n\nThis conf lict not only reflects the Brazilian STF's lack of compliance with previou s IACHR jurisprudence concerning amnesty\, but it reveals an absence of di alogue from both sides.\n\nIn this paper\, I analyze some aspects of the r easoning developed in both decisions as well as the institutional characte ristics that have contributed to this lack of communication.  In the end\, I argue that the strength (and the future) of the Inter-American system d epends on the development of strategies of engagement and cooperation betw een the jurisdiction at both the international and the domestic levels.\n \nLe conférencier\n\n[En anglais seulement] Luiz Magno Pinto Bastos Jr. is an Associate Professor at Universidade do Vale do Itajaí\, in Brazil (sin ce 2000)\, teaching Constitutional Law\, General Theory of State\, Human R ights Law\, and Constitutional Procedural Law\, at Law and International R elations faculties (undergraduate studies). He also is a partner of the Me nezes Niebuhr Law Firm\, practicing in Electoral\, Constitutional and Admi nistrative Law.\n DTSTART:20160216T180000Z DTEND:20160216T193000Z LOCATION:NCDH 609\, Chancellor Day Hall\, CA\, QC\, Montreal\, H3A 1W9\, 36 44 rue Peel SUMMARY:Conflict and Indifference between the Inter-American Court of Human Rights and National Tribunals\, and the Case of Brazilian Amnesty Law URL:/law/fr/channels/event/conflict-and-indifference-b etween-inter-american-court-human-rights-and-national-tribunals-and-case-2 58455 END:VEVENT END:VCALENDAR
