 i sera prononcée par Mary Eberts.  Résumé  Dans son interprétation de l'ar
 ticle 35 de la Loi constitutionnelle de 1982\, la Cour suprême du Canada a
  établi un cadre qui s'appuie fortement sur les concepts démodés du droit 
 colonial. La Cour semble préférer la table des négociations quand il s’agi
 t de concilier souveraineté canadienne et souveraineté des peuples autocht
 ones. La Cour a également indiqué que la « consultation » est le moyen app
 roprié pour le gouvernement de régler les conflits entre l'extraction des 
 ressources et les revendications historiques des peuples autochtones\, mai
 s a déclaré que\, dans ces consultations\, les peuples autochtones n’ont j
 amais l’option de refuser.  Alors que les pressions augmentent pour tirer 
 profit des terres autochtones\, souvent selon un horaire très serré\, cett
 e doctrine de la Cour suprême condamne les Premières nations du Canada à p
 rendre part à une dernière ronde de négociations de «traités»\, où les enj
 eux sont énormes\, le coût de l'échec est potentiellement catastrophique\,
  la position de négociation des Premières nations est ébranlée\, et les pe
 uples autochtones n’ont pas nécessairement les moyens d’engager des avocat
 s et des négociateurs pour de longues périodes.  À propos de a conférenciè
 re  (en anglais seulement) Mary Eberts joined Hensel Barristers as counsel
  in 2013\, after completing her term as Ariel F. Sallows Chair in Human Ri
 ghts at the University of Saskatchewan. She has litigated in trial or appe
 llate courts in most of the jurisdictions in Canada\, in the Federal Court
  and Court of Appeal\, in the Supreme Court of Canada\, and at inquests an
 d administrative proceedings\, appearing as counsel in many leading cases.
  She has been litigation counsel for the Native Women’s Association of Can
 ada for over twenty years\, and was a co-founder of the Women’s Legal Educ
 ation and Action Fund (LEAF).  Mary Eberts writes and lectures\, nationall
 y and internationally\, on constitutional and Charter law\, Indigenous law
 \, and human rights. Ms. Eberts received her legal education at Western Un
 iversity and the Harvard Law School. She has been a faculty member at the 
 Faculty of Law\, University of Toronto\, and held the Gordon Henderson Cha
 ir in Human Rights at the University of Ottawa. Before opening a specializ
 ed litigation practice in 1994\, she was a partner at Torys in Toronto. Ms
 . Eberts grew up in southwestern Ontario\, near Lake Erie\, and is a mothe
