Activity no. 10042849.\nAbstract\nA ssuming that translation is possible - but without denying the\ninherent d ifficulties of that process - this presentation examines\nthe notion of fa ult in Quebec law\, beginning with questions raised\nby its translation.\n The point of departure of this exercise brings us to the\ndifficulties fac ed by translators and editors working on the\nSpanish version of the trili ngual Civil Code of Québec. The goal is\nto examine how these difficulties in translation may aid a renewed\nunderstanding of fault in Quebec law. F or that\, it will be\nnecessary to return to French law\, an important sou rce for the laws\nof Quebec and Latin America\, focusing\, in particular\, on the\nvarious interpretations it has received.\nFrom this examination o f the Other\, we will move to an\nintra-civilian analysis of the 'text of departure'\, the 'text of\narrival'\, and the family of civil law. This wi ll help establish a\nthird perspective that will remove us from the usual English -\nFrench\, common law - civil law binary approach\, allowing an\n examination of familiar and foreign laws in a manner that will\nreveal nei ther to be wholly familiar or foreign.\nAbout the speaker\nJimena Andino D orato completed bachelor's\n(1994) and master's (2002) degrees in law in B uenos Aires\, where\nshe practiced as a specialist in civil law and in neg otiation\, and\nas a mediator. She has taught civil responsibility at seve ral law\nfaculties in Buenos Aires. Upon arriving in Quebec\, she worked a s a\nlegal interpreter and she helped to organize and she taught\nworkshop s on legal Spanish. She was then accepted to the doctorate\nprogram at the Faculty of Law at the University of Montreal.\nShe is currently writing h er thesis on jurilinguistics and\napproaches to the comprehension of law. She has published articles\nand commentaries in specialized journals in Ar gentina and France\nand has lectured in Argentina and Quebec.
